The California Vehicle Code was created in 1935 and DUI was included in section 502. The first commonly used legal limit for blood alcohol concentration (BAC) was .15. From 1959 to 1981 the DUI laws were found in section 23102. At this time they were moved to section 23152 and the legal limit was lowered to .10. It wasn’t until 1989 that the legal limit was lowered to .08. There has been talk about lowering the legal limit to .05 but it doesn’t seem to have garnered enough support to move forward.
